If you are under contract with Davis Homes in the Indianapolis area, walk no run away from your contract before it ends up costing you thousands of extra dollars. Davis Homes is getting its new homeowners slapped with liens on their brand new homes that Davis built and failed to pay all of their contractors. I have bogged about some nasty rumors about Davis Homes and also a bone head marketing move regarding their website, but nothing like this.
Davis Homes appears to be on the verge on disaster and they are taking unwitting homeowners along with them. I have spoken with several homeowners in the Hamilton County area that have been served with these liens and have court documents to support their claims. The liens that have been recorded at the Hamilton County Courthouse that involve homeowners are coming from a contractor of theirs “Creative Touch Interiors” who allege that they provided “materials, labor, services, and/or equipment for improvements to the property” in the last 60 days and have never been paid. Some homeowners have received a letter from Brad Davis, the president of Davis Homes, stating that this is a mistake and the lien has or will be paid. However, at this point this is just lip service and no evidence has emerged that these liens have been paid.
Although the homeowners I have spoken to seem to think this is a widespread problem involving dozens of homeowners, I was able to find 3 liens that involved homeowners as well as Davis Homes. While I am certainly not an expert at researching court documents, I was able to find 3 separate communities where homeowners are being served with liens: Countryside in Westfield, Lakes at Towne Road in Carmel, and Sedona Woods in Fishers. I have included a copy of one of the liens that has been filed; I have blurred out the homeowner’s name because although this is a public record I wanted to respect their privacy. Here is one lien that has been filed naming Davis Homes and the homeowner making a claim for more than $9,000:

What exactly is a lien?
According the Indiana Department of Financial Institutions:
“A mechanic's lien is a claim against real estate which the person who asserts the claim says was benefited by improvements he or she made. This person will be referred to as the "lien claimant." By statute, the lien claimant must follow specific requirements in order to secure a valid mechanic's lien against your real estate. Unless he or she does so, the lien may not be enforceable.”
I am under contract with Davis Homes, should I walk away from my deposit?
This is a hard one to answer, because no one really knows what is going on behind the scenes. If your earnest money deposit is only $500, you might want to consider cutting your losses and moving on with your life. If you are intent on closing on your Davis Home, I would highly recommend you consult an attorney before closing on your home.
Doesn’t Title Insurance Cover Mechanic Liens?
Most of the time, no. Title insurance really only covers liens if the title company made a mistake and missed a lien while they were searching the property to insure the title was clear. In these cases, the mechanic’s liens were filed after the closing date so the title insurance would not cover them. This is why at time of closing the seller, Davis Homes, is required to sign an affidavit stating that they do not owe anyone any money on this property and that there are no liens they know about on the property.
Again consult a qualified attorney, but there are a few things you can do to improve your odds if you do choose to close on your Davis home after reading this. You can make sure that the builder signed affidavit is signed and dated on the actual closing date. You also need to go over the title insurance with a fine tooth comb and also ask them to date it the day of closing. Sometimes the title insurance is dated for weeks before the close of escrow, affectively not insuring any liens from that date forward. In addition, most title companies put a slew of exclusions in the title policy that protect them even further. However, just by asking you can get most of those exclusions removed which should give you a little extra protection.
What is the Future of Davis Homes?
I guess no one but a few people actually know the answer to this one, but future seems quite bleak for Davis Homes. While I was at the Hamilton County Courthouse, I came across another lien that was filed on the second section of one of their Noblesville communities, Brighton Knoll, for the hefty sum of $191,000. Glen - You would think so, but I have seen it where the title commitment is dated weeks before the closing. Pretty shocking, huh? I don't know if this happened in these particular cases, but it does happen.

You were right insider. I had a feeling it would come to this, but all I had were rumors until now. Those people on the west side are probably the lucky ones. Not having your home started is far less severe than being saddled with a 9K mechanic's lien.

Beware of Davis Homes

I'm up to my knees with problems in my "New" Davis Home. The last chapter started this past Saturday when we received a court summons naming us in a legal suit against Davis Homes. Appears they failed to do a very important thing when building our home - pay for the material!!!
Legal representation to pursue our interest is upwards of 0.00 per hour and indicates it will start at 00 upwards. The real kicker - we will not be able to recoup our cost.
Looking for anyone with suggestions or who has had a similar experience.
I contacted the poster as we are building with Davis Homes. I spoke with her regarding the issues and they were the same as what you have listed on your site. We have already paid 00 and are trying to decide what steps to take at this point as our home will be ready at the end of June.

Rachell- What are you going to do? I would be really really careful if plan on closing on your Davis home. Have you had any problems with the construction of your home? Any delays, etc? How much do have invested into the home?

We are uncertain right now. We have had problems from the start. We were delayed 3 1/2 months prior to the start of building our home (due to switching lumber vendors). Then we have had building problems. The entire process has been frustarting. We have invested thirty five hundred dollars as of now. Their customer service is an issue. It is very difficult to find information on the current state of the company. They have been closing and selling models very quickly. Most of the individuals who we started with are no longer with Davis. The Davis Design Studio has closed the message states they are building a new one in Fishers. We are just trying to get as much information as possible to help us decide what to do.

We have a lawsuit in Johnson County courthouse against Davis Homes in April 2008 and we would appreciate anybody who would help us testify in our case of Fraud and Breach of Contract. Apparently, Davis has been taking consumers' deposits for homes, not building and then refusing to return deposits and interest on the monies they have rec'd. Davis has forced consumers to incur court & attorneys' fees to the consumers detriment and lots of customers' have just walked away letting Davis have their money. We stand to lose over $50,000.00 to build with another builder as Davis took us out of the market for other builders' in 2004,2005 and 2006 by delaying our build by corporate maneuvers such as not returning phone calls, not giving estimates in a timely manner, firing staff every 3 mos, etc. We hope to have consumers call us and join us in filing a Class Action Lawsuit against Davis Homes for the fraud they have been committing against the people of Indiana. We are in the phonebook. If busy, keep trying! We are getting everyone's names and calling them back. Thank you.

@ Rachell - I actually spoke with them on the phone. They are trying to get a class action, but their issue is something different. Apparently, they have been trying to build with Davis for over 3 years.
@ insider - I heard they were only down to a few salespeople as well. It sounds like the walls are really closing in on them. This could ugly very soon.

They(Davis Homes) do sign an affidavit at closing that states they do not owe anyone any money on the home. The problem is, if they are lying and declare bankruptcy the debt could ultimately fall on the homeowner. If they are signing these things knowing full well liens exist, that is very sad that they would stoop to such levels.
I think that sign on the car was the lady on the topix forum.

I live on the southside in the Davis subdivison Southlake. Homes here are also having liens filed with Johnson County. I have not received one but my sister who lives in the same neighborhood has. Davis has sent her a letter stating they are sorry and that it will be taking care of. Now she has a brand new home with a mechanics lien on it.

@insider - Eagles Homes? That is a new one on me. I just looked up the name Eagle Homes on the secretary of state website and couldn't find anything relating it to Davis Homes.
@ Belinda - It seems this problem is pretty widespread. I don't know, but I think these letters and just an attempt to buy time before they officially declare bankruptcy. Who the lien on your sister's house from?

I just spoke with another homeowner in the Bay Creek East subdivision in McCordsville and it seems Davis Homes has struck again. She just closed on her house about 1 month ago and is now saddled with a $5000 mechanic's lien. She should be posting something here shortly.

On the heels of the IBJ article about Davis Homes here is an email I received from another person in California where the exact same thing happened. She has given me permission to post this:
I came across your website today and I actually do have a story to tell you so that you can share with your readers.
We're from CA and came across a broker that helps out-of-state investors. Long story short we bought a model home from Davis Homes in the Brighton Knoll community in Noblesville, IN. We only bought the home because it was a lease back and the rent that Davis Homes was going to pay us back was very good - above market value. The positive cash flow was very nice. Our lease agreement was for 3 years. This dream soon ended after 6 months when Davis Homes no longer paid the rent. No letter, no call to tell us this was going to happen. So after being 10 days late for the Jan 2008 payment and after many calls to Davis Homes Jerry Crone of Davis Homes told us that they are no longer paying the rent. I asked for something in writing and until this day that has not happened.
So the nightmare begins.......we hired a property manager to rent our home and find that there are lots of repairs to be done. Davis Homes sales office staff, which is next to my property, was kind enough to tell my property manager that there was a flood in the property that started on the second home. I have since hired a repairman to help me us with the repairs and he comes across new things everyday. First he has no idea how it would of past a home inspection. The siding of the house is falling off, there is wood rot already in some areas, there was no caulking done around doors and windows. The list goes on. We actually have a 2 year warranty on the home which is worthless since no one has ever replied to my request for service. Laura Wedding is in charge of the warranty department and who knows what she's doing with the all the request I've sent. Not once has she replied to me. It's impossible to get through anyone at Davis Homes. What makes me very upset is the lack of communication and courtesy. I called them about the interior doors to the house which are missing, I called them about the garage door opener that is not even there at all. If they would just be honest with me and work with me I would work with them as well. No one wants their business to fail and if they are going through hard times I can understand that but to have breached on our contract and to top it off be rude in the sense that they are not being responsive with just giving us updates, answering our questions, it's like they want to dig themselves in a bigger whole. They are making many people very angry and in the process loosing their integrity.

I have signed a contract with Davis to build in Plainfield and I obviously wants to cancel the contract. I have put a stop payment on the deposit check and I was hoping someone would know what I need to do next.

Erin- This is far from legal advise, but normally a contract must be signed by all parties and be delivered to be considered valid and enforceable. Has the seller,Davis Homes, signed it given you a copy?

been told this week that the Bay creek east community is done. no more buliding. what happens to the vacant lots? what happens to homes that are finished? ie(sod)? where is the pool that was promised? sad sad day for the folks who have built in there. that was to be 200-280 thousand dollar home. they going to get there moneys worth when they try to sell in an unfinished community.

I am sure another builder will come in and acquire those empty lots. The only question is who and what will they build. I don't know for sure but I would guess the pool would be the responsibility of the developer not the builder.

Ha Ha.. i live in the Orchard park sub-division at Epler and Bluff on the southside and we TOO have new homeowners with NUMEROUS mechanics liens on thier properties. Davis also has control of our Homeowners Association AND our Homeowners assoc. fees that are NOT being used for what they are SUPPOSED to be used for. We had to threaten a lawsuit just to get them to cut the grass in our common areas ! Not to mention our neighborhood is only half developed and seems to be NO SIGN of it being completed - atleast by Davis. So ANYONE out there if you have issues with Davis that are pretty major, file your lawsuits NOW before they file bankruptcy..it coming!

Sugar Grove has been taken over by M/I and Ryland. Davis is going to finish building the last few homes under construction and then close the doors. They have one superintendent left. I sub contracted for Davis over 13 years and up till 2 years ago it was a great company.

you may not find many homeowners who will know anything about liens on there houses because the courts are so far behind with all the filings.we were told that the title company was holding money back for vendors with liens but we were finaly paid and released ours.the homeowners i took liens papers too had no idea that the bills were not paid or that there were liens on there property.i would advise people that closed in the last six months to check with there title company or they may get a big surprise when they go to sell and do title searches.

the company that did all there carpet and hardwood was paying for there design center until they got a couple hundred thousand behind on there bills then they loaded up all there stuff in the back of a semi trailer andhauled it to a storage warehouse somewhere up on north side.i heard that from a pretty good source.i also heard that they only have two sales people left and they are mainly trying to sell specs and models.i also heard that they sold the model at lakes at towne road for ninety thousand less than list price.sounds like they are trying to suck all the cash out before the bank takes over.they gavethe one at willow glen away too from what i heard.that was a dumb move to try too build there anyway.i bet the lot is worth more than the house.

I know there were liens on greythorne-rosswood ashland point-oriole point and sugar grove but when the homeowners started recieving copies it got somebodies attention and the bills got paid and the liens were released.but that was just one vender.i also live in a davis home and its a great house. now i worry that the houses that are closing now are going to hurt the reputation of davis homes.thats not going to hurt the davises its going to hurt the people trying to sell there davis home later down the road.

There is nobody at the 82nd street Davis Homes corporate office anymore. The voice mail the main line goes to explains you have to leave a message because the receptionist is on the other line. However, I dropped by today to discover there is no longer a receptionist. There is a sign that says the reception area is now on the lower level (ie, basement). When you go downstairs to the lower level office there is a sign that says "by appointment only". That huge office is abandoned.

I am not a Daivs Homes client, I actually live in Michigan and there is a company here called Symphony Homes that is doing the same thing. We closed on our $200,000.00 home in Sept 2007. In November 2007 I recieved a notice of lien for $25,000.00 from a supplier that Symphony failed (i say that lightly) to pay. We are filing suit right now against Symphony. Does anyone know what happens if Symphony files bankruptcy? Am I stuck with it? This is one of those things that if it sounds to good it probably is!!!!

I bought a spec from Davis few weeks ago and I am having the same problem. It has been more than 3 weeks and they have not addressed all the maintenance issues to the date. Their VP of operations is serving as construction supervisor. I am going to BBB if my issue does not get resolved shortly. Any other suggestions? I am at not sure either if they will honor the 90-day or 1-year walk through.

I hope you did get a deal on this house because insider is right, I am pretty sure you can count on making those repairs yourself. I wouldn't count on a 90 day and especially not a 1 year walk through.
Your real estate agent really should have been in the know about this situation. Maybe he/she should my blog to keep up to date

I am sure this list will continue to grow. We are in a similar boat with Bob Lundsford from RDJ Custom Homes. He has been paid but has failed to manage the draws properly which has lead to a LOT of vendors not being paid.
It finally came to head and we took posession of the final draw to ensure the vendors got paid. Unfortunately, we found out that the last draw (~$24K) does come near covering the near $100K debt still needed to be paid.

We just closed on a house in Brighton Knoll Subdivision in Noblesville...as of last weekend it is now dba Westport Homes. Their signs are everywhere, but their website is not updated, so I can't find any information that way. What does this mean for our home built by Davis? Will this mean no 90 day - 1 year walk-thru? Does Westport take over the existing home...or will it only be responsible for new homes? Not sure how this will work.

westport is working to take over all the lots that davis left in most if not all the subdivisions from what i hear.they will have nothing to do with existing homes but when they get everything straightened out you will be filling up and the houses they put in will look good and blend well give them a little time to get going i heard as soon as they put a sign in oriole pointe the people started complaining about weeds in empty lots.sorry kevin you still need to try and contact davis for service but you had a good super at brighton i can tell you that and erving if your listening you should give westport a call.

Erving (sp?) was let go weeks ago. Tony the VP became the construction superintendent but has no juice to make anything happen. Davis is also operating as DH acquisitions LLC and they are liquidating their remaining assets at auctions before the end of the month. See ads such as the following in the Indy Star:

Does anyone know of a number to reach Davis or if anyone knows who they used to do their siding? I've called Westport who told me to call Davis, but they didn't have a contact number. We just closed on our house, but some of the siding is starting to slip. Whatever info you can get for me would be great!

We had purchased one of the very last homes built in Sugar Grove, Plainfield. One of the critical conditions we imposed on Davis Homes is proof of all construction related debt paid before closing, in which Davis complied with. We had several preventable quality issues that we had Davis correct during each step of the building process which lengthen the entire building timeline to eight months.
We asked Davis management several times during the last three months if they were going to cease operations. Davis Homes answered “No” each time and said they would be around to honor the 90-day and 1-year walk though.
Since the closing of Davis homes, we found a 10-inch crack in our toilet. We called the original plumbing contractor directly and they exchanged it free of charge. If you can find the contractor that originally completed the work, chances are they will honor their workmanship and product for a limited time as if you dealt directly with them. Davis puts the names of the some of the contractors on the front of the main breaker box. Most of the contractors are only known to Davis Homes. We were lucky enough to get a list of all the contractor names that worked on our house to verify they were paid for their services.
I will try and find the list and provide you with our siding contractor, maybe they were the same.

I have a Westport Homes built house that has just now passed it's one-year anniversary. Working with Westport Homes has been a very bad experience. Their customer service is absolutely unacceptable. It is exhausting to get them to repair things that should be repaired. I am to the point of getting a lawyer now. Others in my new neighborhood are also voicing the same concerns. I wished I had never given my money and built with them. Please be careful in your dealings with them.

for clients consider these question when looking for a home builder so you wont get scammed!
Was the project done on time? Was it within the specified budget? How long has he been in the business? Is he licensed? Bonded? Insured? What does better business bureau says? Don't forget these items. You don’t want your dream house deteriorating before you even live in it.

You would think that the title insurance company would update the initial title commitment to the date of closing and date of recording the deed. Is this not done in Indianapolis area? It is done that way in the Naples area.
